Welcome to Storytel

By signing up for a Storytel account, you are entering into a legally binding agreement with Storytel. Before you enter the wonderful world of stories, please take a moment and read these Terms of Use carefully. These Terms of Use are important since they regulate the relationship between yourself and Storytel - and as such affect your legal rights and obligations.

Storytel Sweden AB and its affiliates (hereinafter “Storytel”, “us”, “our” or “we”) offers a subscription service with personalized features and functionalities (the “Service”) that allows our users (hereinafter “you”) to access audiobooks, ebooks and other content (the “Content”) made available over the Internet via the Service to a compatible internet-accessible device.

In order to access our Services, you need an active Storytel account. When creating an account, you must agree to and accept these Terms of Use. Additionally, an active subscription is required to use the Service. Most subscriptions are regulated by additional subscription specific terms (“Subscription Terms”) which you accept when signing up for that subscription. Information on the subscription plans offered can be found on your local Storytel website.

Apart from these Terms of Use, your agreement with Storytel is also regulated by: (i) the information that you are provided with during the purchase; and (ii) any Subscription Terms that you accept for your specific subscription. Together, all information that regulates your relationship with Storytel is called the “Agreement”.

Storytel provides the Service subject to the terms and conditions set forth in the Agreement. If you do not agree to the Agreement, you may not use the Service nor access or consume any Content provided via the Service.

The effective version of the Terms of Use and of Subscription Terms can be found on Storytel's website.

You can find more information on Storytel's website and in our Help Center.

1. Age Limit and Account Eligibility

To be eligible to enter into the Agreement and set up an account or enter into a subscription plan with Storytel you must:
  • be at least eighteen (18) years old and/or otherwise have authorization and legal power to enter into this agreement by law in the country where the Service is made available to you;
  • be a resident of the country in which the Service is made available to you;
  • provide correct personal information where requested;
  • provide a valid payment method;
  • agree to adhere to the Agreement.

2. The Service

Storytel provides a personalized digital subscription service through which you can stream and/or temporarily download (for in-app cached offline reading and listening only) the Content via a compatible internet-accessible device. The Service is accessed via the Storytel application or any other Storytel preinstalled software and may only be used for your non-commercial personal use of such in accordance with the Agreement.
In order to use the Service, you must either use i) a device compatible with Storytel’s technical requirements, and/or ii) one of Storytel’s business partner platforms, onto which the Storytel application or any other Storytel software are installed. The Service may not have identical functionalities across all devices and platforms. For a list of the technical requirements for using the Service, a list of Storytel’s business partners, and a list of the currently accepted payment methods, please visit Storytel’s website.
Storytel updates its application regularly, in order to ensure the security of the application, as well as for updating and improving the user experience. For these reasons, Storytel may at times require that you update to a newer version of the application.
Storytel reserves the right to, at any time, modify the technical requirements for the use of the Service and to change, add or remove business partners and payment methods. Such modifications and changes will be posted on Storytel’s website.

3. Subscription plans

Storytel offers various subscription plans, as amended from time to time. Information on the subscription plans currently provided by Storytel may be found on Storytel's website.
The Service provided to you will depend on the type of subscription plan that you have signed up for.
Storytel reserves the right, at its own discretion, to remove existing subscription plans or to change any features or functionalities of its subscription plans. Changes to the subscription plan can be based on various factors, e.g. improving/managing the Service, complying with rights holders’ requirements or legal or technical requirements. Where such changes negatively affect an existing subscription in more than a limited way, you will be informed and will have the possibility to terminate the subscription, see section 11 and your Subscription Terms.

4. Content Filters

Any pre-installed content filters, such as e.g. “Kids mode” or other similar filter functions that may be offered in the Service from time to time, are offered to you as an optional function. Since the information that the filters are based on is provided to Storytel by other parties, such as the publishers of the Content, Storytel does not take any responsibility for the accuracy or adequacy of these filters and cannot guarantee that these filters will work to your personal satisfaction.
If and where a pre-installed “Kids mode” filter is offered to you, the settings of this filter have been made based on information from the Content’s publishers that such Content is suitable for children aged twelve (12) years old or younger. This means that the Content made available in "Kids mode" may include any and all content and genres in the Storytel content catalogue intended for kids up to the age of 12. Storytel can not in any way guarantee that the filter is completely accurate or that it with complete certainty has filtered all non-relevant content in accordance with what has been intended.

5. Free Trial and other campaigns

Your Subscription may start with a free trial period of the Service (“Free Trial”) or other campaign. The Free Trial and other campaigns are intended to allow users to try the Service for free or for a reduced price for the first time. As such, a Free Trial may not be used more than once per person. Free Trial and/or campaign eligibility is determined by Storytel at its sole discretion and Storytel may limit the eligibility to prevent Free Trial or campaign abuse. Storytel reserves the right to revoke or terminate a Free Trial or campaign if Storytel, in its sole discretion, determines that a user is not eligible. You may not combine Free Trial or campaign offers with other offers.
When you sign up for a Free Trial, you acknowledge and agree that you will automatically be transferred to a paid subscription plan at the end of the Free Trial unless you cancel your subscription before the first payment, in which case you will not be charged and your subscription will be canceled.

6. Prices and Payments

Prices are displayed on Storytel's website and will be clearly communicated to you when you sign up for a Subscription. Prices may vary depending on the type of subscription plan and/or payment method used. If prices vary, Storytel will communicate this on Storytel's website in connection to the general information on prices. Prices do not include any data communication costs or fees which your internet or telecommunication service provider may claim under your contract with such a service provider.
You may, at any time, switch between different subscription plans. Storytel may, at its sole discretion, allow such switches to occur before the end of the current subscription period.
Storytel may make changes to the price of the Service by giving you written notice at least 30 days in advance. Such notice will always give you sufficient time to cancel your subscription before the new price goes into effect. By not canceling your subscription, you accept the new price for the Service. Changes in price can be based on various factors, e.g. improving/managing the Service or amending compensation to rights holders.
Subscriptions are paid in advance (or as otherwise agreed) until the subscription is canceled. Storytel does not provide any partial or full refunds or credits once the subscription is started, except as otherwise specified in the Agreement.
As regards credit cards, please be informed that Storytel may refuse or block credit cards that are not issued in the country in which the Service is offered to you. Storytel also reserves the right at any time and at its own discretion to deny certain types of credit cards.

7. Gift Cards

Storytel may offer different types of gift cards. Some gift cards may be product-specific, which means that such a gift card is connected to a specific subscription plan. Any such gift card can only be used together with such a plan. When you activate a gift card while you have a paid subscription, the paid subscription will be paused for the duration of the gift card subscription period.

8. Intellectual Property Rights

The Service and the Content is our and/or our licensors’ copyrighted property. All trademarks, service marks, trade names, trade dress, domain names, patents, inventions, trade secrets, copyrights, database rights and all other intellectual or industrial proprietary rights (including know-how), in the Service or the Content are owned by us or our licensors, or any affiliated companies to us or our licensors. No element of the Service or the Content may be used or exploited in any way other than as part of the Service offered to you and to the extent expressly permitted under the Agreement. We do not transfer any rights (including intellectual property rights) or title to the Service or any part thereof to you, nor do we transfer any such rights or title to the Content or any portion thereof. Additionally, nothing shall be construed as Storytel granting, by implication or otherwise, any license or right of use of any trademark displayed on or within the Service or the Content to you.

9. Content and Software License

The Content in the Service is constantly evolving and is regularly updated in order to e.g. improve the Service or adhere to legal requirements, intellectual property rights, rights holders’ requests or our internal content policies. This means that the Content offered to you via the Service may vary from time to time and between the different countries and regions where the Service is available, and that Content may be changed, removed or updated without notice. The Content may also vary depending on your current location while accessing the Service. For information on the Content currently available in your country, please visit the Storytel App.
The Service is configured to enable the use of the Service software and the Content, owned or licensed by us. Subject to the terms of the Agreement and your payment of any applicable fee, Storytel hereby grants you a limited, revocable, non-exclusive, non-sublicensable, non-transferable license to access and use the Service software and the Content (within the Service only) for your personal non-commercial use via a compatible internet-accessible device.
You acknowledge, warrant and agree to procure that you, and/or anyone to whom you allow access to the Service via your account, will not copy, reproduce, duplicate, modify, adapt, create derivative works from, display, publish, distribute, disseminate, broadcast, transmit, sell, rent, lease, lend, sub-license or circulate or otherwise exploit for any purpose (commercial or otherwise) any material, Content and/or part of or all of the Service (including, without limitation, the display and distribution of the Content, the Service and/or any other material via a third party website or otherwise).
You also acknowledge, warrant and agree to procure that you, and/or anyone to whom you allow access to the Service via your account will at all times abide to the Agreement and specifically not; (1) redistribute, circumvent or disable any content protection system or digital rights management technology used in the Service; (2) decompile, reverse engineer, disassemble or otherwise reduce any Service to a human-readable form; (3) remove any identification, copyright or other proprietary notices; or (4) access or use the Service in an unlawful or unauthorized manner or in a manner that suggests an association with our products, services or brands.
Use of the Services and/or Content in breach of this section 9 shall always be deemed to constitute a material breach of this Agreement and may be cause for copyright infringement claims.

10. Third-party content and links

Storytel is not responsible for and does not warrant the quality or the safety of any hyperlinks and/or other elements generated by third parties accessible from the Service, our website and/or any forums provided by Storytel, both inside and outside of the Service.
The Service may integrate, be integrated into, or be provided in connection with third-party services and content. Storytel does not control those third-party services nor their content, and such services may be subject to separate terms and/or policies. You should carefully read any agreement, terms of use and/or privacy policies presented to you that apply to such third-party services and/or content.

11. Duration and termination

The below section 11 will apply unless otherwise specified when signing up to the Service or in any Subscription Terms.
Storytel may, at its sole discretion, at times offer customers to pause their current subscription.
If you end your subscription, it will expire at the end of your current subscription period. If you have taken advantage of a Free Trial offer, which has not yet expired, the subscription will end immediately.
Storytel may terminate the Agreement with immediate effect at any time and without prior notice if you fail to comply with the Agreement or with any applicable laws, rules or regulation, or if you otherwise use the Service in a fraudulent way or in a way that may cause damage to Storytel, its affiliates, or any third party.
Termination shall have no effect on the parties' rights or obligations under Section 8 ("Intellectual Property Rights"), section 13.7 (User Generated Content) or other terms of the Agreement that by their nature remains in effect even after termination of the Agreement. Upon the expiry or termination of the Agreement, for whatever reason, all licenses automatically and without further actions cease to apply and shall revert to Storytel.

12. Storytel’s rights and responsibilities

Storytel may at times contact you. All communication between Storytel and you will be in accordance with Storytel’s privacy policy.
We aim to make the Service available around the clock, seven (7) days a week. However, Storytel provides no guarantee that the Service will always be free of errors or interruptions. If there are any faults or interruptions affecting the Service, Storytel shall be given the opportunity to correct these without being in breach of the Agreement. Storytel also has the right, within reason, to close the Service, for example, if needed to carry out upgrades and maintenance.
Storytel has the right to, fully or partially, transfer its rights and obligations under the Agreement to third parties. Storytel also has the right to engage subcontractors to carry out its obligations under the Agreement. Any such changes which may affect the processing of your personal data shall be handled in accordance with the Storytel Privacy Policy.
Storytel may, at its own discretion, make changes in the Agreement. When Storytel makes material changes to the Agreement that negatively affects the Service or your Subscription, this will be communicated to you e.g. by sending you an email, text message or a notification via the Service. Such communication will be sent by Storytel at least thirty (30) days before the changes take effect, allowing you to cancel the Subscription ahead of the changes if you so wish. Your continued use of the Service will constitute your acceptance of the changes. It is therefore important that you read any notice or message from us carefully. If you wish to terminate your Subscription due to such updates or changes in the Agreement you may do so by following the instructions set out in section 11 and your Subscription Terms.

13. Your rights and responsibilities

You may only use the Service for your personal non-commercial use in accordance with the terms of the Agreement and as expressly permitted under section 9. You are responsible for maintaining sole control over your account and to prevent undue access to the Service. You also undertake to follow any requirement on password security and to not reveal your password or any other personalized details associated with your account to anyone for as long as you subscribe to the Service. If another person is allowed access to the Service according to these Terms of Use, you shall procure that those who access/use the Services observe the terms of this Agreement in all respects and you shall be liable for any breach of the terms of this Agreement from such individual.
If you are offline from the Service for a period of thirty (30) days or more, Storytel may block your access to the Service until you go online again. This is to ensure that you still have an active subscription to the Service and to manage updates in the Content.

You acknowledge and accept that Storytel has the right to monitor, review, remove or disable access to any User Generated Content at any time and at Storytel’s sole discretion. We ask that you please keep our service and communication channels as respectful and relevant as possible.
You hereby grant Storytel a perpetual, worldwide, royalty-free, non-exclusive, non-revocable, transferable and sub-licensable unrestricted right to use, including but not limited to host, reproduce, modify, distribute, display and in any other way make publicly available any and all of your User Generated Content in any now existing or future media for commercial purposes or otherwise, including but not limited for the purpose of marketing Storytel, the Service, the Content and/or its licensors and/or business partners.
You have no right to transfer your rights and obligations under the Agreement, unless you have Storytel’s written consent to do so.
You must not use the Service in any way that causes, or is likely to cause, the Service to be interrupted, damaged or impaired in any way, nor will you use the Service or your device for any unlawful or fraudulent purposes.
